Wrongful Death Compensation

Trusted Accidental Death Attorneys in Bergen County/Hackensack, New Jersey

Since 1930, Goldman, Davis & Gutfleish, P.C., has provided protective legal advocacy to individuals and families throughout Bergen County and beyond. During the worst times of life, our attorneys are there to help.

Our Hackensack attorneys, led by Evan L. Goldman, a Certified Civil Trial Attorney, have extensive experience representing surviving family members in legal claims for wrongful death compensation from the responsible parties. We understand that a financial settlement or jury award can never replace a lost family member. However, we have also seen how families benefit from receiving full and fair compensation via wrongful death lawsuits. A family member’s death can create significant money worries, especially if the individual was the family’s main wage earner; one of the purposes of these types of lawsuits is to fill that gap.

If you have lost a loved one to accidental death caused by the negligence or intentional actions of another person, we encourage you to contact our Bergen County office for a free and private consultation.

What Is a Wrongful Death Lawsuit?

After a death caused by another person, survivors of the deceased, including the spouse and minor children, may be able to file a wrongful death compensation claim against the party responsible for causing the death. When an accident results in the death of a child, the child’s parents may also be entitled to bring a claim against the person who caused the accident. In limited circumstances, the adult children of a deceased person or the parents of a deceased adult may also be eligible to sue for damages in a wrongful death action.

The purpose of a wrongful death lawsuit is to allow the survivors of the deceased to recover for the injuries they have suffered as a result of the death of their loved one. Depending on the circumstances and the relationship between a survivor and the deceased, the damages in a wrongful death suit may include compensation for the following:

  • Loss of earnings
  • Loss of support and services
  • Loss of companionship, protection, advice or guidance
  • Conscious pain and suffering
  • Medical and funeral expenses
