Harry Gutfleish has aggressively represented debtors, creditors, creditors’ committees, liquidating trusts and bankruptcy trustees in all aspects of bankruptcy proceedings and commercial litigation for more than 20 years.
Harry has served as lead counsel or has managed a variety of complex litigation in bankruptcy cases and in other courts involving issues relating to corporate governance and breaches of fiduciary duty, fraud, professional malpractice, debt collection and fraudulent transfers, and contract disputes, among others. He also has represented individuals and businesses in a variety of avoidance actions brought by debtors and bankruptcy trustees, as well as debtors in litigation in which a plaintiff seeks to block a debtor’s bankruptcy discharge or to block the discharge of a particular debt.
Harry has represented various financial institutions and other lenders in bankruptcy cases, collection matters, and out of court work-outs.
As counsel to court appointed fiduciaries, Harry has investigated several significant real estate, mortgage, securities, healthcare, and investment frauds committed by debtors and their principals, and has pursued the alleged wrongdoers and others on behalf of creditors. The Federal Bureau of Investigation presented Harry with a Certificate of Appreciation for “outstanding assistance in a joint investigative effort” leading to the criminal prosecution and conviction of various defendants, for Harry’s representation of the bankruptcy trustee for NJ Affordable Homes Corp., a real estate Ponzi scheme in New Jersey.
Harry has served as a panelist for seminars sponsored by the Bergen County Bar Association, the Institute of Continuing Legal Education, and the New Jersey State Bar Association, including those addressing the basics of chapter 11 bankruptcy practice, issues in cases involving fraudulent and criminal conduct, the pit-falls of bankruptcy for non-bankruptcy practitioners, state law liquidation alternatives, the interplay and tensions between matrimonial and bankruptcy proceedings, and corporate governance in chapter 11 reorganization cases.
Harry is a member of the Register of Mediators approved by the United States Bankruptcy Court for the District of New Jersey and the United States Bankruptcy Court for the District of Delaware for those Courts’ mediation programs.
Harry has been selected for New Jersey Super Lawyers since 2009, and has been named in 201 Magazine as one of Bergen County’s Top Lawyers since 2012.
